1. Condition of ponies: There is no warrantee expressed or implied by the auctioneer of APPS. Title to the horse is to be free of all adverse claims to ownership, use or possession. All horses must have a negative coggins (not older than 6 months prior to sale date). All horses are to be sound of sight and wind. No horse is to have navicular disease or foundered. Cribbers must be announced. All horses are to be drug free. Any horse on medications must be accompanied by a veterinarian’s certificate stating the type and reason.
2. Services: Aiken Polo Pony Sale is acting only as sales agent and has no responsibility other than to conduct the actual sale.
3. Bidding: Sales are final at the fall of the hammer, at which time the purchaser assumes all responsibility.
4. South Carolina Sales Tax: All horses sold at the APPS will be sold as Beast of Burden and thus be tax exempt under South Carolina tax law.
5. Payment: Buyer shall pay seven percent (7%) to APPS and ninety-three percent (93%) to the seller. Buyer must present themselves to the APPS office within one hour of the end of the sale. Payment will be check, certified check, cash or credit card (add 3% if using credit cards).
6. Catalog and Web Site: Buyers and sellers understand and agree to the terms of the catalog and the website: www.aikenpoloponysale.com.
7. APPS and the website will list the horses entered in the sale including information regarding them as furnished and represented by the seller. The seller is responsible for the condition of each horse he/she enters. Announcements: Announcements made the day of the sale take precedence over printed material, verbal statements or information contained on the website.
9. No-Sale Fee: A no-sale fee of 5% of the final live bid will be incurred by any horse not selling through the auction. This fee must be paid before owner and horse depart the sale grounds.
